These terms and conditions shall be governed by and construed in accordance with the substantive law of Barbados.
As a condition of use of the CCREEE website, the user agrees to indemnify the CCREEE and its servants and agents from and against any and all actions, claims, losses, damages, liabilities and expenses (including legal costs and fees) arising out of the use by the user of the site and/or any material contained thereon, including, without limitation, any claims alleging facts that if true would constitute a breach by the user of these terms and conditions.
Any dispute, difference or claim arising out of or relating to or in connection with the CCREEE website or the contents or use thereof or these terms and conditions shall be submitted to and finally determined by arbitration. Such arbitration shall be conducted by a single arbitrator and shall be conducted in Barbados and in the English language. The decision of the arbitrator shall be binding on the CCREEE and the user and enforceable in any court of competent jurisdiction. The user agrees to submit to the exclusive jurisdiction of the courts of Barbados for the resolution of any dispute not subject to arbitration and for the enforcement of any award made by the arbitrator.
The user hereby agrees and acknowledges that the intellectual property rights in the material and information contained on or accessible via the CCREEE website are owned by the CCREEE and/or third party content providers. The user further agrees and acknowledges that the rights and interests of the CCREEE and/or any third party may be irreparably injured by unauthorized use of any material or information contained on or accessible via the CCREEE website and, further, that monetary damages would not be an adequate remedy for any breach of the terms and conditions governing the use of the site and/or such material and information. The user therefore agrees that notwithstanding and in addition to any other rights or remedies available to the CCREEE and/or any third party in respect of the breach of these terms and conditions the CCREEE and/or any third party shall be entitled to seek specific performance and injunctive or other equitable relief in connection with any breach or anticipated breach of said terms and conditions, including interim relief from a court of competent jurisdiction.
